I actually don't think the suarez clause was the same, I got the impression their was a gentlemans agreement say he could speak to a champions league club if they bid over 40m.

I wouldnt say they mean jack sh*t, in spain they are written into every contract by law. Even over here we signed ba from Newcastle for just the 8m because of his contract.

 

 

Arsenal were misinformed about the Suarez clause, they thought it was a £40m buyout clause but it turned out that it was if Liverpool received a bid above £40m they were contractually obliged to make Suarez aware of the bid, however they did not have to accept.

I don't need to read it, we now all know what the deal was with Suarez. At the time no one knew and were specualting all sorts just like what is happening with Costa just now.

Who knows whats in his contract and what the exact terms are....mainly just Atletico and the club interested in buying him...not anyone behind a keyboard.

Hopefully we get this deal done soon as well. I was expecting to see Costa officially signed before Cesc was, considering we 'agreed to a deal' with Atleti months ago.

Regarding the Suarez Arsenal fiasco, people need to keep in mind that the contract is between LFC and Suarez.  Suarez could have a buyout option of 20 quid and Arsenal could bid 500million quid, doesn't mean LFC has to sell to Arsenal..... because the buy-out clause is only initiated if the player wants to leave for the club offering the bid.  I mean its not like we could get Messi against his will just because we meet his buy-out clause, that clause is an agreement between the club and the player, not between the club and anybody who has the cash to meet it.

 

If Suarez really wanted to go to Arsenal all he had to do is call up a semi-competent lawyer/barrister and take LFC to court for violating a contractual obligation (which, if I am correct about Britain's Common Law system, would result in Suarez being released of any obligations inherent to the contact and possibly opening up the ability to take legal action against the other parties in violation of the contract).

 

Regarding paying over the buyout clause, I imagine this only takes place in a context where the player is ok with either clubs (similar stature/personal terms etc) and leaves the decision to the selling club OR the selling club has a clause that roughly states that if the player wants to join club A but club B bids more, club A has to at least match the highest/current valuation bid (club B's) even if their offer is already over the buy-out clause.  Meaning the selling club protects their asset value by ensuring that it can not be sold for under the market valuation (what another club is willing to pay) because some clubs ***cough cough Barcelona cough*** would always bid the buy-out clause or less, even if other clubs are willing to double it, and just manipulate the player/media into helping coerce a move through at a low valuation.
