For a start, I'm fairly certain that portugaese law, like Spanish law (which is better understood by people like me) doesn't actually tax you for activating a buyout clause. No reputable source has said otherwise. It's been a lot of "I think, based on what I read in a paper which reported what another paper said" For a second, Benfica might be stubborn, but they are in no way going to take 120m up front and force us to pay 40m in taxes rather than take 121m from us up front and we pay 0 in taxes. They are stubborn but they aren't stupid. So if we go to release clause benfica will just take whatever we offer. My view is what we are trying to avoid is paying it all in one lump. We maybe offered 100m now and 25m in installments. But that's to avoid the whole lump in one go which affects accounting for some reason. This isn't really a debate, it's just logic.
